PURCHASING PROCEDURE
Placement of an order for a product/products
1. The buyer selects the desired product and clicks the button “Add
to cart”. When the product is added to cart, it can be seen in it. The cart can
be accessed by the buyer by clicking the cart icon, which is shown in the top
right corner.
2. If the selected product does not suit the buyer, they may
remove it from the cart by clicking X (remove). 3. If the buyer wishes to continue
the purchase (buy other products), they click “Continue the purchase”.
4. When the buyer selects all desired products, they enter all
necessary data in the sample form at the Cash Register.
5. When the buyer confirms the order (by clicking the button “Finalise
the purchase”), they can no longer change the order via the website.
Order being processed
– After placing the order, the buyer receives an email that
their order has been received and is being processed.
– Any changes or the cancellation of an order may be performed
by the buyer within 3 (three) hours of confirming the order online, i.e. at the
email address: sales@positiveboards.com
– Product dispatch: the seller dispatches the goods to the buyer
within the agreed period and in the agreed manner.
TERMS AND CONDITIONS
The General Terms and Conditions of the online store have been
drawn up in line with the Consumer Protection Act, Personal Data Protection
Act and Electronic Communications Act.
The General Terms and Conditions lay down the operations of the
online store, the rights and obligations of the user and store, and the
business relationship between the seller and buyer.
You are advised to read carefully the General Terms and
Conditions below before placing an online order. By using the website, you
express your agreement with the terms and conditions indicated. The company
ASPIA, Aljoša FIJAVŽ s.p. reserves the right to amend the Terms and Conditions at
any time on the www.positiveboards.com website. All amendments shall be binding
upon buyers, which is why you should review the current Terms and Conditions before
placing an order.
Purchase safety
The www.positiveboards.com website is an online store that is
managed by the company ASPIA, Aljoša FIJAVŽ s.p., Zeče 49, 3210 Slovenske
Konjice, VAT ID No: SI31946909, which is also an e-commerce service provider
(hereinafter also “Seller”). For any information related with your order and
delivery, you can call the phone number: 031332611 or send an email to:
sales@positiveboards.com. The user is bound by the General Terms and Conditions
applicable at the moment an online order is placed. The placement of an order
does not imply the conclusion of a sales contract. A sales contract or a
purchase order is stored by the Seller and can be received by the buyer upon a
written request at any time within 5 years of the executed order. Before the
goods are delivered, the Seller shall have the right to contact the buyer over
the phone or by email in order to verify the contact data submitted. If the
Seller is unable to make contact with the buyer based on the data submitted,
the Seller may consider the purchase order placed as null and void.
Method and cost of delivery
Shipments are delivered by Pošta Slovenije. If the product
ordered is in stock, you will receive it within 5 to 7 working days. The cost
of delivery for the products offered in the online store shall be paid
separately by the buyer. The goods ordered will be dispatched to the address
indicated upon the placement of an order. Delivery shall be made from Monday to
Friday during morning hours. If the product ordered is not in stock, you will
be informed thereof and presented other products or informed of the delivery
period for the product ordered.
Payment options in the online store
The online store operates by payment based on a pro-forma
invoice to the transaction account of the company ASPIA, Aljoša FIJAVŽ s.p.,
Zeče 49, 3210 Slovenske Konjice (the buyer does not pay commission on the
payment amount). The buyer is to enter the purchase order ID (#xxxx) as
reference in the payment order. Products will not be dispatched to your address
until payment is received in the company’s bank account. The buyer will receive
the invoice for the purchase along with the products upon the delivery of the
package.
Payment is also possible through the PAYPAL system.
Prices
The online price applies to all purchases made in the online
store. The applicable product price is the one published on the date on which
an order is placed. All prices include VAT.
Warranty claims
The Seller shall be held responsible for the factual defects on
the products purchased in the online store. The buyer shall send a warranty
claim to the email address: info@positiveboards.com within 8 days of the
purchase and request immediate replacement for the same, flawless product or
within the statutory period and under the conditions laid down for the enforcement
of a warranty claim arising from a factual defect. The buyer may return the
goods by sending them by mail and enclosing a copy of the invoice or by
delivering it personally to the company’s registered office, as agreed in
advance with the Seller. If the buyer wishes to return the goods at the cost of
the company, they are required to arrange that with an employee of ASPIA,
Aljoša FIJAVŽ s.p., Zeče 49, 3210 Slovenske Konjice. Otherwise, it is not
possible to return the goods at the cost of the company.
The right to withdraw from the purchase – the
return of goods
The buyer shall have the right to return the purchased goods within
fifteen (15) days of accepting them with no compensation whatsoever.
Nevertheless, the buyer shall be obliged to bear the costs incurred upon the
return of the subject of the purchase. The buyer shall be required to inform
the Seller in writing of an intended return of goods with a notice of
withdrawal within 15 days of receiving the goods, i.e. by mail or at the
contact email address info@positiveboards.com, and to return the goods within
15 days of the sent notice of withdrawal. The return of the received goods
within 15 days of their receipt with no prior written notice shall also be
considered as withdrawal from the purchase. Products are to be unused,
undamaged and factory sealed in original packaging. A copy of the invoice is to
be enclosed. The provider shall return the total purchase amount within 15 days
of receiving the goods returned. The address for the return of goods to the
Seller is ASPIA, Aljoša FIJAVŽ s.p., Zeče 49, 3210 Slovenske Konjice. It is
recommended to use a delivery service that enables the tracking of deliveries
and to properly prepare the products for transport (the buyer may use original
packaging or some other appropriate safe packaging). The cost of delivery shall
always be covered by the sender, unless agreed otherwise in advance. No
consignment for redemption shall be accepted.
Product damage
The buyer shall be obliged to carefully examine the packaging
and its contents upon accepting a product. In case of damage to the product,
the buyer shall be obliged to immediately warn the delivery person (postman) of
any damage. The buyer shall be obliged to draw up an official record together
with the postal worker and complete the section on the product and packaging
condition with particular care. The buyer will surrender the damaged product,
which will be sent together with an official record to the sender’s address at
the cost of ASPIA, Aljoša FIJAVŽ s.p. After receiving the damaged product, the
company will send a new product to the buyer within the shortest possible time.
If the buyer notices damage to the product after its delivery, but no later
than 30 days following the delivery, they shall report the damage to
info@positiveboards.com or to the phone number 031332611. The condition for
registering product damage within 30 days following its delivery shall be the stored
packaging, based on which it shall be ascertained where or how the damage was
incurred. It is also desired that any damage is recorded with a camera and that
such photos are sent to info@positiveboards.com, since subsequent warranty
claims for product damage are taken into account by carriers only exceptionally
and cannot be resolved by the company on their behalf.
Personal data protection
The Seller undertakes to protect all personal data of the user
at all times. The buyer’s data will in no case be disclosed to unauthorised
persons. Personal data protection is also the concern of the user, who is to
ensure the safety of their user name and password and provide adequate software
(antivirus) protection of their computer.
Complaints and disputes
The Seller shall observe the applicable legislation governing
consumer protection. The Seller shall make every effort to fulfil its
obligation to set up an efficient system of complaint handling and to appoint a
person whom the buyer may contact by phone or email in case of any problems. A
complaint shall be sent to the email address info@positiveboards.com.
The Seller will confirm the receipt of a compliant within 5
working days and notify the buyer of the period within which it shall be
resolved, keeping the latter informed throughout the procedure. The complaint
handling procedure is confidential.
The Seller realises that an essential characteristic of a
consumer dispute, at least in respect of court settlement, is the disproportion
between the economic value of a claim and the costs incurred in the settlement
of a dispute. That is also the main obstacle hindering the consumer to bring a dispute
to the court. Hence, the Seller shall make every effort to resolve any dispute
amicably.
Security of the online store
The online store uses several security systems that provide
adequate protection against data loss or abuse.
